ANALISIS RESPON KEBIJAKAN PEMERINTAH TERHADAP KASUS LGBT DALAM IMPLEMENTASI QANUN NOMOR 6 TAHUN 2014 KOTA BANDA ACEH
Abstract
The role of government policy response is very important as an effort to follow up on cases of sharia violations so that perpetrators receive a deterrent effect. This study will analyse the policy response of the Banda Aceh City Government to LGBT cases in the implementation of Qanun Jinayat Number 6 of 2014. The research problem lies in the lack of studies on the dynamics of implementing Islamic Sharia policies, particularly in responding to LGBT issues, as well as the lack of integration of a multi-stakeholder perspective. This study aims to: (1) identify the forms of government policy responses, (2) analyse the challenges in implementing the Qanun Jinayat, and (3) evaluate the socio-legal impacts of the policy on the LGBT community. The research method used a descriptive qualitative approach with case studies through interviews with 12 informants (Islamic Sharia officials, religious leaders, human rights activists, and LGBT individuals), analysis of the Qanun Jinayat No. 6 of 2014, and annual reports from Wilayatul Hisbah (2014–2024). The research findings indicate that: (1) Government policy responses are repressive, with an emphasis on law enforcement (flogging, fines) as an effort to uphold public morality in accordance with Islamic Sharia; (2) The implementation of the Qanun Jinayat faces challenges due to the dualism of Sharia law and national law, as well as the lack of data on LGBT cases due to stigmatisation; (3) This policy has triggered social impacts, including the exclusion of LGBT groups and an increase in public reporting, which has resulted in no significant reduction in homosexual practices.
